Crl.O.P.No.5602 of 2023 A.D.JAGADISH CHANDIRA, J., The petitioner, who apprehends arrest for the alleged offences under Sections 379 of IPC r/w.Section 21(1) 21(2) of of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.61 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had illegally transported 1/4 unit of odai sand by using tractor without any valid licence. Hence, the complaint.

3. The learned counsel for the petitioners would submit that the petitioner is innocent and he has been falsely implicated in this case. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (crl.side) would submit that the petitioner and other have transported 1/4 unit of odai sand using tractor. He would further submit that the petitioner has three previous case of similar nature. 5. Taking into consideration the fact that the petitioner is having three previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.
