There is no representation on behalf of the applicant who is the sixth defendant in the above suit. This application has been filed to strike off the name of the applicant / sixth defendant for misjoinder of parties from the above suit.

2. The facts on record indicate that this Court by an order dated 30.09.2019 granted exparte injunction in favour of the plaintiff and 11 different Advocate Commissioners were appointed to inspect place of the respective defendants.

3. As far as the applicant / sixth defendant is concerned, one of the Advocate Commissioners visited the premises of the applicant / sixth defendant. The Advocate Commissioner has given a list of inventory taken from the applicant / sixth defendant, which prima facie indicates the involvement of the applicant / sixth defendant. Thus, the applicant / sixth defendant is responsible for answering to the allegations in the plaint.

4. Considering the above, I am of the view that prayer in this application for striking off the name of the applicant / sixth defendant from the suit cannot be acceded. Accordingly, this application is dismissed.
