The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 120 (b), 408, 420, 477A and 506 (1) IPC, in Crime No.03 of 2023, on the file of the respondent police seek anticipatory bail. 2.The learned counsel for the petitioners stated that the petitioners are arrayed as accused Nos.1 to 3 in this case. The petitioners are innocent persons and they have been falsely implicated in the case registered in Crime No.03 of 2023, for the offences under Sections 120 (b), 408, 420, 477A and 506 (1) IPC. Thus, he seeks anticipatory bail to the petitioners.
3. It is stated by the learned Government Advocate (Crl.Side) that the son of the defacto complainant was doing a business by leasing Coconut and Areca trees to various persons. He took a land on lease and with the produce, he was selling it in the wholesale market. A1 is the Manager of the leasehold land on behalf of the defacto complainant's 1/3
son. A3 is the son of A1. A2 is the friend of A1. It is stated that the son of the defacto complainant died. Taking advantage of that, accused herein had taken away the Coconut and Arecanuts and misappropriated the amount. Entire incident had taken place from the year 2021 onwards. Finally, when the defacto complainant came to know this fact, complaint was lodged and FIR had been registered. Thus, he prayed for dismissal of this petition.
4.The learned counsel for the petitioner states that there is no allegation as against A3. But, it is contended on behalf of the respondent that all the three accused had jointly misappropriated the amounts. The learned counsel for the intervenor is also present and he also asserted that all the petitioners herein, taking advantage of the death of the son of the defacto complainant, misappropriated a sum of Rs.1,49,97,340/-. 5.Taking into consideration the seriousness of the offences involved, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed. sli 17.10.2023 2/3
