This petition has been filed to condone the delay of 354 days in preferring the above criminal appeal.

2. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 354 days is condoned and the petition is ordered subject to condition that the petitioner shall pay a sum of Rs.5,000/- (Rupees Five Thousand only) directly to the respondent within a period of one week from today, failing which the petition stands dismissed automatically.
