This Original Petition has been filed by the petitioner who is admittedly the second wife seeking Succession Certificate under Section 372 of the Indian Succession Act.

2. The first wife of late T.Raman is cited as 1st respondent. Therefore, it is clear that the marriage between the petitioner and T.Raman had taken place during the life time of the first wife and the same is void.

3. A Division Bench of this Court in R.Rajathi Vs. The Superintending Engineer, TANGEDCO and othes reported in 2018 (5) MLJ 385 had held that the second wife is not entitled to family pension.
