PRAYER:

The Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus forbearing the respondents from proceeding further in ARC.No.1576/04-05, on the file of the third respondent until the copies of the Claim Petition in ARC.No.1576/04-05, the Statement of Accounts and the payment details made by the Petitioner in respect of the Petitioner's Mortgage Loan Account No.68/2000-2001, is furnished to the Petitioner.

By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.

The petitioner has prayed in this Writ Petition praying to forbear the respondents from proceeding further in ARC.No.1576/04-05, on the file of the third respondent until the copies of the Claim Petition in ARC.No.1576/04-05, the Statement of Accounts and the payment details made by the Petitioner in respect of the Petitioner's Mortgage Loan Account No.68/ 2000-2001, is furnished to the Petitioner.

3. Today, when the matter was taken up, the learned Special Government Pleader served a copy of the aforesaid claim petition, the statement of accounts and the payment particulars to the learned counsel for the petitioner. The learned counsel for the petitioner also received the said copy.

4. In view of the above, the writ petition has become infructuous and the same is dismissed as infructuous with liberty to the petitioner to make necessary explanation to the respondents. Consequently, connected miscellaneous petition is closed. No costs.
