PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India praying to set aside the fair and final order passed in I.A.No.341 of 2018 in O.S.No.126 of 2013 on the file of the District Munsif Cum Judicial Magistrate's Court, Kodumudi dated 06.12.2018.

The above Civil Revision Petition is filed challenging the order of the learned District Munsif cum Judicial Magistrate, http://www.judis.nic.in

P.T.ASHA, J., mrn Kodumudi dismissing the application moved by the 58th defendant for appointment of an Advocate Commissioner for the simple purpose of verifying as to whether there is a building or not in the suit property. The suit is filed for partition. The application is premature since these issues can be gone into at the time of final decree proceedings. The learned Judge has rightly dismissed the said application. I do not find any infirmity in the order passed by the learned District Munsif Cum Judicial Magistrate, Kodumudi. The Civil Revision Petition stands dismissed. Consequently, connected Miscellaneous Petition is closed.
