Petition praying that in the circumstances stated therein the High Court will be pleased to modify the order in Para No.5 (b) accordingly the petitioner is directed to deposit a sum of Rs.5,90,000/- (Rupees Five Lakhs ninety thousand only) to the credit of Government sick person fund, Tiruppur this Honble court dated 18.02.2020 made in Crl.OP.3362 of 2020 Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.A.SURESH, Advocate for the petitioner and of MR.L.CHARLES PREM KUMAR Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- Learned counsel appearing for the petitioner submits that the present petition has been filed for modifying the order in para No.5 (b), relating to deposit a sum of Rs.

5,90,000/- to the credit of Government Sick person fund, Tiruppur. 2.While granting anticipatory bail, this Court imposed a condition of depositing a sum of Rs. 5,90,000/- to the credit of Government Sick person fund, Tiruppur and the said condition was imposed based on the petitioner's undertaking on his own, by coming forward to deposit the amount of Rs. 5,90,000/-. However, contrary to the undertaking, the present modification petition is filed.

3.Admittedly the anticipatory bail was granted only based upon the undertaking given by the petitioner, relating to deposit only, if not this Court would have considered the matter in a different manner. Therefore, after undertaking to deposit the amount, coming forward with the present modification petition does not paint the good picture against the petitioner.

4. For the reasons aforesaid, the miscellaneous petition stands dismissed. However in the interest of justice, further period of two weeks is granted for depositing the amount of Rs.5,90,000/- as the undertaken given above.
