..Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first Respondent to grant approval of the petitioner's appointment as Sanitary Assistant with effect from the date of his appointment in the second respondent school, i.e. 12.10.2005 and grant him all consequential benefits within a time limit to be stipulated by this Court.

ORDER

The writ petition has been filed for the following relief : " To direct the first Respondent to grant approval of the petitioner's appointment as Sanitary Assistant with effect from the date of his appointment in the second respondent school, i.e. 12.10.2005 and grant him all consequential benefits within a time limit to be stipulated by this Court."

The case of the petitioner is that he was appointed as Gardener in the second respondent-School on 01.08.1999 and was redesignated and appointed as Sanitary Assistant on 12.10.2005 on account of vacancy that arose, owing to the promotion of an incumbent. Subsequently, the petitioner was appointed as Sanitary Worker on 05.12.2011, in a newly created sanctioned post and since then, he was working in the said post in the second respondent-School.

The grievance of the petitioner is that despite his possessing the required qualification prescribed for the post of Sanitary Assistant, and necessary proposals have been sent by the respondent-School to the first respondent as early as on 09.01.2013 and 03.01.2019, the first respondent has not taken any action so far. The petitioner had also sent a representation to

the first respondent on 31.12.2025, and the same was also not considered to date. Hence, the petitioner is before this Court.

4. Heard the learned counsel on either side and also perused the materials placed before this Court.

5. Considering the plea of the petitioner that he possessed the required qualification and also that the second respondent-School has sent proposals to the first respondent on 09.01.2013 and 03.01.2019, seeking approval for appointing the petitioner in the post of Sanitary Assistant, this Court directs the first respondent to consider the representation of the petitioner and to pass orders, within a period of three weeks from the date of receipt of a copy of this order.
