O R D E R

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the present Habeas Corpus Petition is for a direction to the respondents to produce the detenu Duraipandi, aged about 40 years, son of Arumugam and set him at liberty.

2.The petitioner states that she married the detenu Mr.Duraipandi on 10.10.2000 at Sivan Temple. Out of the wedlock, two male children born and the petitioner and the detenu were residing at Sivaganga District.

3.The learned Government Advocate appearing on behalf of the respondent police, on instruction from the respondent police, states that matrimonial disputes are pending between the petitioner and her husband Mr.Duraipandi/detenu. On account of the said matrimonial disputes, the detenu left the matrimonial home and now residing at Door No.544, Nallakulam, Vadamathur Post, Sivaganga District-630 551. On interrogation, the detenu informed the police in clear terms that he is not willing to live with the petitioner.

This being the facts ascertained from the detenu himself by the police and the residence of the detenu also has been identified, this Court is of an opinion that no further adjudication needs to be entertained in respect of the grounds raised in this Habeas Corpus Petition. If at all any other grievance exists for the petitioner in respect of the matrimonial issues, it is left open to her to adjudicate the same before the competent Court of law in the manner known.

5. With these observations, the present Habeas Corpus Petition stands closed.
