Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the 3rd Respondent to consider the Representation made by the Petitioner through letter dated 21.01.2022 concerning the issue benefits of his father as such Provident Fund Gratuity Settlements and also the Pension benefits in my favour within the stipulated time prescribed by this Court.

O R D E R

The learned Government Advocate takes notice for the transport Corporation. With the consent of parties, writ petition is taken up for final disposal.

2. According to the petitioner, the petitioner is a son of the deceased K.L.Baskaran, who was working in the respondent transport Corporation as a Conductor (Sel.Gr.) and died on 22.2.2020 intestate leaving behind the entire family without any source and he is the only breadwinner to his family. The petitioner has made representation to the third respondent on https://hcservices.ecourts.gov.in/hcservices/

21.1.2022 on the death of his father, for settlement of Provident Fund, Gratuity and also pension benefits. But so far no order has been passed by the respondent. Therefore, the petitioner is before this Court.

3. Considering the limited scope of prayer as sought for by the petitioner, the third respondent is directed to consider the representation, dated 21.1.2022 and pass appropriate orders, within a period of 12 weeks from the date of receipt of copy of the order, after giving opportunities to the interested parties if any.

4. With the above directions, the writ petition stands disposed of. No costs.
