ORDER

This civil miscellaneous petition has been filed by the petitioner herein, who is the third party seeking to grant leave to challenge the Judgment and Decree dated 11.11.2025 made in O.S.No.4258 of 2024 passed by the XIII Assistant Judge, City Civil Court, Chennai.

2.Learned counsel for the petitioner submits that the 1st respondent has preferred the impugned suit with fraudulent nature with the collusion of the 2nd respondent. The respondents fraudulently obtained a Judgment and Decree dated 11.11.2025 made in O.S.No.4258 of 2024 on the file of the XIII Assistant Judge, City Civil Court, Chennai against the petitioner. He further submits that the power agent of the plaintiff in the suit is a habitual offender in respect of land grabbing cases against whom several criminal cases are pending before the Courts and the power agent was convicted by the Chief Metropolitan Magistrate Court for CBI and CBCID cases, Egmore in C.C.No.5701 of 2023 and also criminal and SARFAESI cases against him is pending and disposed in C.C.No.237 of 2023, C.C.No.126 of 2021 and Crl.M.P.No.13900 of 2024 before Poonamallee and Thiruvallur Courts. The said power agent through the

invalid sale deeds made an illegal attempt through his son preferred the suit as against the petitioner's mother in O.S.No.4063 of 2024 in respect of petitioner's another family property. Therefore, he prays that the lower Court without analysing the documents in the proper perspective allowed the suit which is illegal and perverse and the same is liable to be set aside. 3.Heard learned counsel for the petitioner and perused the materials available on record.

4.Considering the facts and circumstances of the case and being satisfied with the reasons stated in the affidavit filed in support of this petition, the Civil Miscellaneous Petition is ordered as prayed for. 5.Registry is directed to number the Civil Revision Petition if it is otherwise in order.
