Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorari to call for records of the proceedings of the second respondent in Na.Ka.No.2305/2015/A5, dated 15.06.2016, and to quash the same.

O R D E R

The petitioner has filed this Writ Petition, praying for issuance of a Writ of Certiorari to quash the proceedings of the second respondent, dated 15.06.2016.

The case of the petitioner in short is that, feeling aggrieved against the order passed by the second respondent/Joint Commissioner, the petitioner has preferred a Revision Petition, being R.P.No.198 of 2016, before the first respondent/Commissioner, H.R & C.E. Department, and during the pendency of the said Revision, the second respondent/Joint Commissioner, by the impugned proceedings, dated 15.06.2016, has called for a fresh election meeting to be held on 01.07.2016, which has been stayed by this Court, by order, dated 29.06.2016, made in W.M.P.No.18990 of 2016 of this Writ Petition.

When the Writ Petition is taken up for hearing today, the learned counsel appearing for the petitioner as well as the learned Special Government Pleader for the respondent/H.R. & C.E. Department submitted that the Revision Petition filed by the petitioner before the first respondent/Commissioner H.R & C.E. Department has been heard and orders have been reserved. Therefore, both the parties agreed that they will abide by the decision to be taken by the first respondent in the said Revision Petition.

In view of the subsequent developments taken place during the pendency of the Writ Petition, nothing survives in this Writ Petition for adjudication. However, it is open to the parties, whoever is aggrieved against the orders to be passed by the Appellate Authority, viz., the first respondent/Commissioner to approach this Court. Accordingly, the Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petitions are closed.
