PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, praying to direct the Subordinate Judge, Namakkal to dispose of the C.M.A.No.2 of 2007 expeditiously. For Petitioner : Mrs.S.Umamaheswari for Mr.S.Senthil

O R D E R

According to the petitioner, the respondents 1 to 4 are the appellants in C.M.A.No.2 of 2007, which was filed against the fair and decreetal order passed in claim petition in REA.No.927 of 2005 dated

06.12.2006 before the Subordinate Court in Namakkal.

2. The learned counsel for the petitioner would submit that the aforesaid appeal has been filed in the year 2007. After entered appearance by the parties concerned, the appeal has been posted for arguments from time to time. The said appeal has been posted on the ground that awaiting lower court records from the trial court. Therefore, the petitioner has filed the present Civil Revision Petition before this Court.

3. The learned counsel for the petitioner would further submit that the said records are available in the lower court and hence there is no legal impediment to dispose of the aforesaid appeal filed by the respondents 1 to 4.

4. On the above fact and the submissions of the learned counsel for the petitioner, in the interest of justice, this Court is inclined to direct the Appellate court to dispose of the appeal in C.M.A.No.2 of 2007 as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order, if there is no other impediments.

5. The Civil Revision Petition is disposed of with the above direction. No Costs.
