O R D E R

This Criminal Miscellaneous Petition has been filed seeking cancellation of anticipatory bail granted by this Court in Crl.O.P.No.4505 of 2025 on 19.02.2025, to the first respondent/2nd accused, mainly on the ground that the earlier anticipatory bail application in Crl.M.P.No.319 of 2025 filed on 29.01.2025 before the learned Principal District and Sessions Judge, Erode, was suppressed by the first respondent herein/accused -2 and also before withdrawing the bail application in Crl.M.P.No.319 of 2025, he moved the bail application in Crl.O.P.No.4505 of 2025 before this Court and obtained the order.

2. Heard the learned counsel for the petitioner and the learned Government Adocate (Crl.Side) appearing for the respondent Police and perused the materials available on record.

In the order dated 19.02.2025 in Crl.O.P.No.4505 of 2025 passed by this Court, it has been observed in para 4 that the learned Senior Counsel brought to the notice of this Court about the pendency of the anticipatory bail application in Crl.M.P.No.319 of 2025 on the file of the learned Principal 2/4

District and Sessions Judge, Erode and that a memo was also filed for withdrawal of the said application on 18.02.2025.

4. In view of the above said facts, the first respondent cannot be held guilty of any suppression. Accordingly, the Criminal Miscellaneous Petition filed by the petitioner to cancel the anticipatory bail granted to the first respondent, is hereby dismissed.
