ORDER
This criminal original petition has been filed to direct the respondent not to harass the petitioner.
2.The learned counsel appearing for the petitioner submitted that based on the complaint given by one Gunasekaran, the respondent police sent a letter dated 14.02.2026 stating that the petitioner to be appeared before them on 19.02.2026. Due to his ill-health, the petitioner not appeared. He further submitted that it is a civil dispute and the petitioner already filed a criminal petition in Crl.O.P.No.2682 of 2026 before this Court, which was ordered. Now, the respondent police sent another notice and harassing the petitioner. Hence, this petition.
3.Further, the learned counsel for the petitioner, on instructions, submitted that the petitioner will be ready to appear before the respondent police on any given date.
4.The learned Additional Public Prosecutor submitted that the respondent police received three complaints against the petitioner for receiving a sum of Rs.4 lakhs, 3.30 lakhs and 15 lakhs from the complainants for getting job in Ennoor Power Plant.
5.Heard the learned counsel appearing for the defacto- complainant.
6.Considering the submissions made and on perusal of the materials available on record, it is seen that against the petitioner, there are three complaints against the petitioner. In fact, one of the complainants namely Gunasekaran approached this Court and made his submissions. From the said Gunasekaran/defacto complainant, the petitioner received a sum of Rs.15 lakhs on the promise that he would get employment for him in Ennoor power plant. On the submissions of the public prosecutor, it is seen that Ennore Power Plant acquired lands for the project on the undertaking that employment would be provided to the family members of the land owner. In case, there were no legal representatives, they were permitted to nominate a person for employment. According to the respondent police, three complaints have been received. The petitioner collected amounts of Rs.4 lakhs, Rs.3.30 lakhs and Rs.15 lakhs from three persons. For that purpose, the petitioner was called for enquiry.
7. In view of the above, the petitioner and Gunasekaran/defacto complainant are directed to appear before the respondent police on 12.03.2026 along with supporting documents, if any and thereafter, the respondent police is directed to enquire and proceed in accordance with law.
