O R D E R
This petition has been filed, directing the respondent to consider the petitioner's representation on 21.02.2025 and to recall and revoke the Lookout Circular issued against her son, Vignesh, S/o. Manohar, holding Passport No. Y60166188, in connection with Crime No. 10 of 2024 in C.C. No. 155 of 2024, on the file of the learned Judicial Magistrate Court at Sholingur.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first to third respondents and perused the materials available on record.
3. The petitioner is the mother-in-law of the de-facto complainant and on her complaint, the third respondent registered the First Information Report in Crime No. 10 of 2024 for the offences punishable under Sections 498(A), 506(2), and Section 4 of the Dowry Prohibition Act, as against all the family members of the petitioner. Right now, the petitioner's son is abroad. While the petitioner filed an Anticipatory Bail Petition in Crl.O.P. No. 8205 of 2024 before this Court and the same was closed on the ground that there was a settlement between the parties. However, the de-facto complainant proceeded further and the third respondent, after completion of the investigation, filed a final report and the same has been taken cognizance in C.C. No. 155 of 2024, on the file of the Judicial Magistrate Court, Sholingur, Vellore District. Therefore, the Lookout Circular was issued as against the petitioner's son and it is pending. Hence, the petitioner's son apprehends arrest at the hands of the third respondent, whenever the petitioner's son visits India.
4. Admittedly, the third respondent completed the investigation and filed the final report and the same has been taken cognizance before the
Trial Court. No summons have been issued so far. Further, the petitioner's son now wants to visit India on 10.03.2025.
5. In view of the above, the respondents are directed to keep the Lookout Circular issued as against the petitioner's son in abeyance. The petitioner's son is directed to visit India and appear before the Trial Court on 10.03.2025, on the condition that the petitioner's son shall co-operate for the trial in C.C. No. 155 of 2024. Thereafter, the petitioner's son can visit abroad only after obtaining prior permission from the Trial Court.
6. With the above observations and direction, the Writ Petition stands disposed of. Consequently, the connected Miscellaneous Petition is closed. No costs.
