Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 4th respondent to refer the case pertaining to Na.Ka.No.08/2013/A dated 07.06.2013 to the Civil Court in terms of Section 20 of the Tamil Nadu Highways Act, 2001 within a time to be fixed by this Court.

It was pointed out by this Court that the matter pertains to the acquisition made under the Tamil Nadu Acquisition of Land for Industrial Purposes Act. However, the body of the affidavit and the prayer reads as if the relief is sought for under Tamil Nadu Highways Act.

2.The learned counsel submitted that he may be permitted to withdraw the writ petition with a liberty to file a fresh writ petition by making correct averments in the affidavit. 3.Accordingly, this writ petition is dismissed as withdrawn with liberty to file a fresh writ petition. No Costs.
