The petitioner, who apprehends arrest at the hands of the respondent police for the offences under Sec.406 & 420 I.P.C. in Crime No.668 of 2021 on the file of respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant received a sum of Rs.19,00,000/- from the petitioner on 23.05.2019 and executed a bond in favour of petitioner. Inspite of lapse of several months, the defacto complainant has not repaid the said amount and only recently, the defacto complainant has paid a sum of Rs.11,00,000/- to him and the balance amount of Rs.8,00,000/- remains outstanding. For the remaining amount, the defacto complainant handed over six cars. Later, he has repaid a sum of Rs.21,00,000/- along with interest. However, even after receipt of entire loan amount, the petitioner failed to hand over the cars to the defacto complainant. Hence, the complaint.

3. The learned counsel appearing for petitioner would submit that this is the second petition praying for anticipatory bail and when he

demanded to repay the loan amount, the defacto complainant has lodged the present false complaint. He would also submit that he is an innocent person and he has not committed any offence as alleged in the complaint. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner is having one previous case similar in nature and this is the second petition seeking for anticipatory bail before this court. If he is granted anticipatory bail, he will abscond and also tamper the witnesses. Hence, he vehemently opposed to grant bail to the petitioner.

Considering the facts and circumstances of the case and the submissions made by both counsel and considering the gravity of offence committed by the petitioner and also considering the fact that there is no change of circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 06.07.2022 rpp
