(Order of the Court was made by M. SUNDAR, J.) The dispute centres around Survey No.125/2 in 058 Pattukkonampatti Village, Pappireddipatti Taluk, Dharmapuri District (hereinafter 'said property' for the sake of convenience and clarity).
2. The central controversy is as to whether the said property is a water body or a part of it has been set apart to be used as a burial ground.
3. As regards captioned writ miscellaneous petition (hereinafter 'WMP' for the sake of brevity), while official respondents do not oppose the prayer, the private respondent/writ petitioner submits that he has no objection to the WMP petitioner being heard as an intervenor. Learned counsel for WMP petitioner very fairly agreed to be heard as an intervenor.
4. In the light of the narrative thus far, captioned WMP is ordered by writing that WMP petitioner Mr.M.Shanmugam, S/o.Malayan, is not impleaded as a party respondent, but, shall be heard as an intervenor and given audience. https://www.mhc.tn.gov.in/judis

5. Captioned WMP is disposed of in the aforesaid manner. There shall be no order as to costs. Registry is directed to carry out necessary and consequential amendment by showing WMP petitioner as intervenor without giving him rank.
6. List the captioned WP a fortnight hence.
7. Learned State Counsel to get instructions whether 'said property' is a water body or a part of it has been allotted/set apart to be used as a burial ground. List on 30.06.2025.
