ORDER

The Revenue Divisional Officer, Krishnagiri, is suo-motu impleaded as the 7th respondent in this writ petition.

Mr.S.Jayachandran, learned Government Advocate, takes notice for respondents 1 to 4 and 7.

This writ petition has been filed for the issue of writ of

Mandamus directing the 1st respondent to deal with the representation made by the petitioners on 03.02.205 wherein the petitioners have sought for the cancellation of patta standing in the name of respondents 5 and 6.

Heard Mr.R.Narendran, learned counsel for the petitioner and Mr.S.Jayachandran, learned Government Advocate for respondents 1 to 4 and 7.

In the considered view of this Court, if the petitioners are seeking for the cancellation of the patta granted in favour of the respondents 5 and 6, it will be more appropriate for the petitioners to submit a representation before the RDO, Krishnagiri. This is in view of the fact that the RDO has the Appellate jurisdiction under Section 12 of the Patta Passbook Act. In view of the same, there shall be a direction to the petitioners to submit a fresh representation before the RDO, Krishnagiri along with all the relevant documents and also a copy of this order. On receipt of the same, the RDO, Krishnagiri, shall deal with the representation on its own merits and in accordance with law after affording opportunity to respondents 5 and 6 and final orders shall be passed within a period of twleve weeks from the date of receipt of a fresh representation from the petitioners.

This writ petition is disposed of with the above directions. No costs.
