PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents 1 to 3 to take immediate action against respondents 5 and 6 and see that no business in tyres is done in any portion of Door No.8, I Cross Street and also in any portion of I Cross Street, Sapthagiri Nagar, Pachayankuppam, Cuddalore - 607 003 by considering the representation dated 18.01.2023 sent by the petitioner to respondents 1 to 3.

This writ petition has been filed for issuance of a writ of mandamus directing the respondent Corporation to take action on the representation made by the petitioner on 18.01.2023 and to stop the respondents 5 and 6 from continuing to run the wheel vulcanizing shop, which according to the petitioner is causing pollution and the residence in and around the locality are facing hardship.

2. When the matter was taken up for admission, learned Standing Counsel appearing on behalf of third respondent submitted that already a notice has been issued to the petitioner and the sixth respondent seeking to remove the encroachment that has been put up by them. That apart, the representation made by the petitioner has been taken into consideration and in the event of respondents 5 and 6 running the business without obtaining license, appropriate action will be initiated u/s.114-A of the Tamil Nadu Urban Local Bodies Act, 1998.

Recording the submission made by learned Standing Counsel appearing on behalf of the third respondent, this Writ Petition is disposed of. No costs.
