This application is filed to condone the delay of 128 days in filing the written statement. The suit summons was served on the applicant / third defendant on 15.11.2021. The applicant relies on the judgment of the Hon'ble Supreme Court in the suomotu proceedings for extension of limitation periods and the subsequent judgment of the Hon'ble Supreme Court on the issue. In view of the said judgments and by taking into consideration the reasons set out in the affidavit, the applicant has made out sufficient cause. Accordingly, the delay of 128 days in filing the written statement is condoned.
2. The Registry is directed to indicate whether suit summons was served on the second defendant. List the matter on 30.06.2022. The parties are directed to file the affidavit of admission / denial of documents filed by the counter party and draft issues.
