This petition is filed under Section 378(4) Cr.P.C, to grant special leave to file an appeal against the judgment passed in STC No.102/2016 by the Judicial Magistrate Court, Udhagamandalam dated 28.10.2022.

2. Mr. M. Mohamed Muzammil, learned counsel for the petitioner contended that the trial court, even without hearing the arguments on his side and also based on the evidence of hand writing expert, had acquitted the accused.

3. In such circumstances, there are arguable points in the present case and therefore, leave is granted as prayed for.

4. Registry is directed to number the Criminal Appeal, if it is otherwise in order, call for the records, prepare paper book and list the matter in usual course.
