Writ Petition is filed under Article 226 of the Constitution of India, to pass an order of writ of Mandamus directing the respondents 1 & 2 herein to consider the representation of the petitioner dated 29.11.2020 to cancel the free assignment patta granted to the 4th respondent with respect to the land measuring 0.44.0 hectares comprised in S.No.354/1, Samandahalli Village, Harur Taluk, Dharmapuri District, which has been used as way and cart track to reach the patta lands in S.Nos.358/2B1, 358/1B2 and 358/1B3 and pass necessary orders after hearing the petitioner and the 4th respondent herein within the time that may be fixed by this Honourable Court.

ORDER

This Writ Petition is filed for a writ of Mandamus directing the respondents 1 & 2 herein to consider the representation of the petitioner dated 29.11.2020 to cancel the free assignment patta granted to the 4th respondent with respect to the land measuring 0.44.0 hectares comprised in S.No.354/1, https://hcservices.ecourts.gov.in/hcservices/

Samandahalli Village, Harur Taluk, Dharmapuri District, which has been used as way and cart track to reach the patta lands in S.Nos.358/2B1, 358/1B2 and 358/1B3 and pass necessary orders after hearing the petitioner and the 4th respondent herein within the time that may be fixed by this Honourable Court. 2.Mrs.R.Janaki, learned Additional Government Pleader entered appearance for the respondents 1 to 3 and submitted that an enquiry is scheduled to take place on 21.05.2021 at 3.00 p.m at the office of the third respondent/Tahsildar. 3.The said statement of the learned Additional Government Pleader is recorded.

4.In view of the above, no further direction is required to be given except that the third respondent is directed to issue notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing and to dispose of the matter through a speaking order within a period of eight (8) weeks from 21.05.2021.
