ORDER

This writ petition has been filed challenging the impugned refusal Check Slip issued by the 1 st respondent dated 18.02.2025 and for a consequential direction to the 1 st respondent to register the Sale Deed.

2.Heard Mr.C.R.Gopinaath, learned counsel appearing on behalf of the petitioner and Mr.U.Baranidharan, learned Special Government Pleader appearing on behalf of the 1 st respondent and Mr.N.R.Arun Natarajan, learned Special Government Pleader appearing on behalf of the 2 nd respondent.

3.The refusal Check Slip has been issued by the 1 st respondent based on the objections raised by the 2 nd respondent to the effect that the property belongs to the temple.

3/5 4.In the considered view of this Court, the 1 st respondent can resort to the guidelines issued by the Division Bench of this Court in Sudha Ravi Kumar and another vs. The Special Commissioner and Commissioner, Hindu Religious and Charitable Endowments Department, Chennai and others reported in 2017 3 CTC 135 (Paragraph No.26). 5.Accordingly, a summary enquiry can be conducted and a decision shall be taken by the 1 st respondent, within a period of four weeks with respect to the registration of the document presented by the petitioner, after hearing the petitioner and the 2 nd respondent.
