ORDER : The Court Made the following order :- The petitioner, who was arrested for the alleged offence under sections 363, 366 of IPC and Sections 3(a) & 4 of POCSO Act, 2012 in Crime No.03 of 2022, filed this petition under Section 439 of Cr.P.C. seeking bail.

2.The petitioner herein was arrested on 02.02.2022 on a complaint given by the mother of the minor girl aged 16 years old alleging that this petitioner has kidnapped the minor girl and committed penetrative sexual offence. The petitioner herein states that he and the minor daughter of the defacto complainant were in love and they eloped. Later, the minor girl was rescued and a false complaint has been lodged against him. However, Section 164 of Cr.P.C statement of the victim girl indicates that the petitioner has committed penetrative sexual assault on the minor girl. completed. Since there is every possibility of tampering the witness and distorting the evidence by the petitioner, this petition for bail is dismissed.
