O R D E R
This Criminal Original Petition has been filed seeking a direction to the learned District Sessions and Special Judge for exclusive Trial of SC/ST Cases, Kallakurichi, to consider the Bail application of the petitioners herein on their surrender in connection with Crime No.53 of 2026 on the file of the second respondent police.
2. The case of the prosecution is that A1 and the defacto complainant are husband and wife. The petitioners herein / A2 to A6 are the family members of A1. On 06.06.2025, the defacto complainant and A1 went to their native place for attending a marriage. At that time, A1 left the defacto complainant in her parent house. When the defacto complainant asked when he would take her back with him, A1 abused her communally 2\6
several times. Hence, the case.
3. Heard the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials on record.
4. Considering the submission made and on perusal of the materials, it is seen that the petitioners are from one family. The petitioners 1 and 2 are the parents of Ajithkumar who had married the defacto complainant. It was an intercaste marriage. There was a matrimonial discord between the said Ajithkumar and the defacto complainant and now it has been projected since the defacto complainant belongs to SC community. The petitioners have caused harassment and humiliation and now Ajithkumar has arrested in this case. It is a matrimonial discord and the preliminary allegations against the petitioners stems out of a matrimonial discord.
5. In view of the above factual position, there shall be a direction to the learned District Sessions and Special Judge for exclusive Trial of SC/ST Cases, Kallakurichi, to consider the petitioners' bail application, 3\6
preferably on the same day of their surrender, in connection with Crime No.53 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
