By consent, the writ petition itself is taken up for final disposal.
2. According to the petitioner, his father owned a borewell, which was functioning through electricity service connection. Three phase service connection has also been provided in S.C.No.070-0091849. All of a sudden, during the month of July 2014, a huge sum to the tune of Rs.1,56,861/- was directed to be paid by him. In this regard, the petitioner has submitted a representation dated 29.7.2014 to replace the motor as it shows false reading. On the grievance raised by the petitioner, though Electric Meter was inspected by the officials of TANGEDCO on 18.2.2015, he has not received the Inspection Report and is facing severe hardship without power. Hence, he submitted a representation dated 20.3.2015 to the fifth respondent. Since there has been no response, he came forward to file this writ petition.
3.Heard the submissions of Mr.T.Sundaravadanam, learned counsel appearing for the petitioner, Mr.M.Varun Kumar, who accepts notice for the respondents 1 to 4 and Mr.R.Vijayakumar, learned Additional Government Pleader, who accepts notice for the 5th respondent.
4.The learned counsel appearing for the 5th respondent would submit that the 5th respondent will send the report to the 2nd respondent and the 2nd respondent may be directed to furnish the report to the petitioner. This Court heard the submissions of the learned counsel for the 2nd respondent in this regard.
5. Though the petitioner prayed for larger relief, this Court in the interest of justice, directs the fifth respondent to send his inspection report with regard to the meter in S.C.No.070-0091849 to the 2nd respondent, within a period of two weeks from the date of receipt of a copy of this order and the second respondent in turn is directed to put the petitioner on notice and serve him a copy of the said report within a period of three weeks thereafter. On such representation of the report, it is open to the petitioner to work out his remedies in accordance with law. It is also open to the petitioner to pay the demand made by TANGEDCO without
prejudice to his rights and contentions. On receipt of the payment made by the petitioner, the respondents/TNAGEDCO is directed to restore the electricity service connection to the petitioner. The Writ Petition is disposed of accordingly. No costs. The connected Miscellaneous Petitions are closed.
