Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents to complete the oral enquiry and pass orders in the disciplinary proceedings against the petitioner in letter No.11890 of 2010, dated 15.10.2010 (charge memo No.3 of 2010) within a reasonable time.

O R D E R

The relief sought for in this writ petition is for a direction to the respondents to proceed with the enquiry proceedings initiated against the writ petitioner in proceedings dated 15.10.2010.

2.The learned counsel appearing for the writ petitioner made a submission that the writ petitioner was working as Forest Ranger in Forest Engineering Division, Trichy. On account of certain allegations, a charge memo was issued against him in proceedings dated 15.10.2010. However, the respondents have not proceeded with the enquiry and till date no final order has been passed in the disciplinary proceedings. Thus, the learned counsel made a request for early disposal of the disciplinary proceedings.

3.Without going into the merits of the case, this Court is inclined to direct the respondents to proceed with the enquiry proceedings in accordance with the Rules and complete the same as early as possible, preferably within a period of six months from the date of receipt of a copy of this order.

4. It is made clear that the writ petitioner should cooperate with the respondents for early disposal of the disciplinary proceedings. During the course of enquiry proceedings, the petitioner should not evade the process of enquiry at any stage. In the event of evading, the respondents are at liberty to record the same in the enquiry proceedings. With these conditions the respondents are directed to conclude the enquiry as early as possible, preferably within a period of six months from the date of receipt of a copy of this order. 4.Accordingly, the writ petition stands disposed of.
