J U D G M E N T
When the matter came up for hearing the learned counsel for the appellant would submit that the sole appellant died on 25.05.2013 and seeks time to bring the legal-heirs of the deceased sole appellant. Though the sole appellant died on 25.05.2013, till date no steps have been taken and the period of 90 days to take steps to bring the legal-heirs of the sole appellant is already over. Hence, the Second Appeal is dismissed as abated. There is no order as to costs. Consequently, connected miscellaneous petition is closed.
