Crl.O.P.No.5637 of 2023 A.D.JAGADISH CHANDIRA, J., The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(i), 4(1)(aaa) read with 4(1-A) of T.N.P.Act in Crime No.89 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner who is the police constable along with another accused had transported 110 Litres of ID Arrack . Hence, the complaint was registered.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Further, he would submit that the petitioner has not been suspended from his service with regard to the alleged offence. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) for the respondent would submit that the petitioner, who is the police constable had colluded with another accused had involved in the transportation of 110 litres of ID arrack. Presence of the petitioner in the scene of occurrence has also confirmed by the CCTV footage and the tower location of his phone. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

Taking into account the nature of offence and the submissions of either sides, and the petitioner who is a member of the uniformed service had assisted the other accused in transportation of ID arrack, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 10.04.2023 mfa
