Heard Thiru.N.Ramanathan, the learned AG & OT, and have perused the materials placed before this Court.

The present application has been moved by the learned AG & OT, along with a report submitted by the learned AG & OT dated 25.02.2026, seeking permission of this Court for donation of a sum of Rs.10 lakhs to Sri Ramacharan Charitable Trust, having office at No.115, Sir P.S.Sivaswami Salai, Mylapore, Chennai - 600 004, as one time donation for the current year alone from the Accumulated Funds (FY 2020-21) belonging to the Trust Estate of Mylai Kandappa Chetty and Arunachala Chetty Charity towards the procurement of montessori materials.

It is submitted by the learned AG & OT, by relying upon the report, that, from the very same applicant, such requests have already been made to the learned AG & OT and by earlier orders in the years 2021, 2022 and 2023, the learned AG & OT had been permitted to donate a sum of Rs.10,26,000/-, Rs.20,00,000/- and also Rs.5,00,000/-, as one time payment, for the respective years. 4. That apart, the very same applicant is also receiving a sum of Rs.30,000/- per month on regular basis for the purpose of expenses to be incurred for maintaining the montessori curriculum and pattern in some of the Government/Corporation Schools in the Chennai City.

The learned AG & OT also submits that, when similar request had been made during the last year, that is in the year 2025, in A.No.2048 of 2025, an order was passed by this Court dated 22.04.2025, thereby, a sum of Rs.10,00,000/- has been allowed as one time payment, therefore, the learned AG & OT would submit that, though larger sum has been sought by the applicant as one time payment for this year, due to the financial position, the Accumulated Funds accrued on the account of the said Charity for the Financial Year 2021 would not permit to donate more than Rs.10 lakhs. Therefore, this year also, similar permission may be granted to the learned AG & OT to donate a sum of Rs.10 lakhs alone to the applicant/Charitable Trust.
6. The said submission made by the learned AG & OT is taken on record and having regard to the factual matrix of the issue and having considered the said submissions made by the learned AG & OT, Page No.2 of 5
including the report dated 25.02.2026 filed by him, this Court is inclined to pass the following orders:- (i) That there shall be permission to the learned AG & OT to donate a sum of Rs.10 lakhs to Sri Ramacharan Charitable Trust, having office at No.115, Sir P.S.Sivaswami Salai, Mylapore, Chennai - 600 004, as one time donation for the current year alone, that is 2025-26, from the Accumulated Funds of the Financial Year 2020-2021, belonging to the Trust Estate of Mylai Kandappa Chetty and Arunachala Chetty Charity towards the procurement of montessori materials.
(ii) The aforesaid permission is granted on condition that, the payment to be released by the learned AG & OT shall be vouched by the beneficiary/applicant Trust by providing evidences/bills/vouchers for having purchased the montessori materials for distribution to the students of the Schools concerned. (iii) Such compliance shall be made by the applicant trust within a period of three months from the date of receipt of the fund and those compliance shall be made directly to the learned AG & OT, who, on receipt of the same, shall file a report to that effect before this Court.
