The above Petition is filed to withdraw and transfer the FCOP No.51 of 2025, pending on the file of the Family Court, Namakkal, to the Sub Court, Tiruchengode.
1/4
2. Reasons for seeking the transfer are as follows:- (i) The petitioner/husband is working at Coimbatore and the distance between Coimbatore to Namakkal is almost 158 kilometres. (ii) According to the petitioner/husband, the Sub Court at Tiruchengode is equidistant from both the petitioner's and the respondent's residence.
3. Heard the learned counsel on either side and perused the records.
4. The distance between Trichengode and Namakkal is not very far and this Court is at loss to understand as to why the petitioner/husband seeks to have the matter transfer to Sub Court, Tiruchengode particularly when neither of the parties is residing at Tiruchengode.
5. In the above circumstances, the request for transfer cannot be granted and accordingly, the Transfer Civil Miscellaneous Petition stands dismissed. However, the presence of the petitioner/husband 2/4
before the Family Court Namakkal is dispensed with on all hearings except for adducing evidence and for counseling. No costs. Consequently, connected miscellaneous petition is also closed. 08.04.2025 (shr) Index : Yes/No Speaking Order: Yes/No To
