This petition has been filed to modify the condition imposed on the petitioner is directed to deposit a sum of Rs.50,000/- into the credit of Crime No. 195 of 2022 before the concerned Magistrate from the date on which the order copy made ready in the above Crl.O.P.No.1726 of 2023 dated 27.01.2023.

2. The learned counsel for the petitioner submitted that as he is a poor coolie worker, he unable to mobilise the amount to deposit into the credit of crime number as directed by this court.Hence, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.30,000/- (Rupees thirty thousand 1/3

only) into the credit of Crime No.195 of 2022 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order and the defacto complainant is permitted to withdraw the said deposit amount on proper identification and acknowledgment and he is also directed to stay at Avinashi and report before the Inspector of Police, Avinashi daily at 10.30 a.m. for the period of eight weeks.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 1726 of 2023 vide order dated 27.01.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
