CRIME NO.14/2007 AND 59/2007 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition of furnishing two sureties, out of which, one surety should be blood surety as imposed by this Court in Crl.OP.No.19729/2020 dated 16.12.2020.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.PARTHASARATHY, Advocate for the Petitioner and of M/S. L.CHARLES PREM KUMAR, Government Advocate (Crl.side) on behalf of the Respondent the court made the following order:- The learned Counsel for the petitioner would submit that the petitioner was granted bail by this Court in Crl.O.P.No.19729 of 2020 by order dated 16.12.2020 and one of the condition imposed by this Court was that the petitioner should produce two sureties out of which, one surety should be a blood surety. He would submit that the petitioner has no relatives and thereby, he is unable to comply with the condition and that he is unable to come out on bail despite, being granted bail on 16.12.2020. Hence, he would pray for modification.
2. The learned Government Advocate (Crl. Side) would submit that the petitioner is a habitual offender and that was the reason that this Court had insisted for blood surety.

3. This Court takes into consideration the fact that the petitioner has no relatives and the that the petitioner had voluntarily surrendered on 14.10.2020 and despite the bail being granted to the petitioner by order dated 16.12.2020, the petitioner is in custody for more than 4 months.
4. In view of the above, the condition 6(a) imposed on the petitioner is modified to the effect that the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned III Additional District and Sessions Judge, Gobichettipalayam. The other conditions shall remain intact.
