Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C., praying, to direct the respondent Police not to harass the petitioner in unknown crime number pending on the file of the respondent police based on the complaint lodged by V.Damayanthi and her husband.

O R D E R

This Criminal Original Petition has been filed praying to direct the respondent not to harass the petitioner based on the complaint lodged by V.Damayanthi and her husband.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. It is represented by the learned Additional Public Prosecutor that on a complaint given by one V.Damayanthi, a petition enquiry is pending in CSR No.280 of 2015 against the petitioner.

4. Under such circumstances, no blanket orders of not to harass can be passed. If the petitioner is wanted either for enquiry or for interrogation, he can very well be summoned by the respondent police and while doing so, the petitioner shall not be harassed. At the same time, the petitioner should submit himself to the respondent for interrogation and enquiry. It is made clear that this order will not shield if the petitioner is involved in cognizable offence.
