Prayer: Criminal Revision case is filed under Section 397 (1) r/w 401 of Cr.PC against the order of the Family Court Judge at Erode in MC No.75 of 2014 dated 29.10.2015 partly allowing the petition and directed the petitioner /Respondent to pay a sum of Rs.3,000/- per month each respondent / petitioner by its order dated 29.08.2015.

This Criminal Revision case has been filed against the order passed by the Family Court, Erode in MC No.75 of 2014 dated 29.10.2015, fixing the maintenance amount payable by the petitioner to the respondent at the rate of RS.3,000/- per month. 2.

Heard Mr.C.D.Johnson, learned counsel for the petitioner and Mr.Ma.P.Thangavel, learned counsel appearing for the respondent.

The petitioner was married to one Saranya in the year 2011 and through the marriage, the respondent was born on 05.11.2012. The maintenance case was filed on behalf of the child represented by her mother.

The Court below took into consideration the income earned by the petitioner and fixed the maintenance amount payable to the daughter at the rate of Rs.3,000/- p.m. While fixing this amount, the income earned and the expenses incurred by the petitioner were taken into consideration. The maintenance fixed by the Court below is not unreasonable and this Court does not find any ground to interfere with the same in exercise of its revisional jurisdiction.

In the light of the above discussion, this Criminal Revision case stands dismissed. No costs.
