ORDER
The petitioner/accused, who is facing trial in Special S.C.No.41 of 2022 for offence under Sections 18, 9(l), 9(n), 10, 3(a) of the Protection of Children from Sexual Offences Act, 2012 and sections 448, 323 and 506(1) of IPC before the learned Sessions Judge, Mahila Court, Perambalur, has filed this Criminal Original Petition seeking to quash the same on the ground of compromise. 2.Case of the prosecution is that the defacto complainant who is second respondent herein, has lodged a complaint before the first respondent police stating that the victim girl third respondent is her younger sister and that she was minor. It is stated that the petitioner herein who is none other than the maternal uncle has come to the victim's house frequently and asked us to get the third respondent victim girl married to him. On one occasion, the petitioner tried to sexually assault the victim girl and when the same was questioned, he has threatened them. Hence a complaint has been lodged and after investigation, the charge sheet has been laid and the case was taken on file as Spl.S.C.No.41 of 2022.

3.Learned counsel for the petitioner submitted that the petitioner and second and third respondents are relatives. Now the victim girl is aged about 20 years and she got married with one Suresh @ Ponnusamy and they are living happily. The victim girl and the defacto complainant are willing to withdraw the case and therefore, the learned counsel requested this court to quash the criminal proceedings.
4.Learned Government Advocate (Criminal side) is before this court. Today, the petitioner, second respondent defacto complainant and the victim girl appeared before this Court, their identity is confirmed by Ms.B.Bhuvaneshwari of All Women Police Station. This Court also enquired both the parties and was satisfied that the parties have come to an amicable settlement between themselves. The petitioner, second and third respondents have filed separate affidavits before this Court and also filed the Joint Compromise Memo, dated 07.01.2026. The second and third respondents further informed that they are not inclined to proceed with the case and ready to withdraw the case. The Apex Court in the case of "K.Dhandapani vs. State by the Inspector of Police reported in 2022 SCC Online SC 1056", considered the subsequent events and observed that the Court cannot shut its eyes to the ground reality and disturb the happy family life of the victim. In view of the same, this Court finds that 3/5
continuation of the proceedings will serve no purpose and it is only an abuse of process of law.
5.Accordingly, this Criminal Original Petition stands allowed and as a sequel, the case in Special S.C.No.41 of 2022 on the file of the learned Sessions Judge, Mahila Court, Perambalur is hereby quashed against the petitioner.
