ORDER

This petition has been filed seeking a direction to the respondent police, particularly, the 3rd respondent, to register a case based on the petitioner's

complaint dated 21.08.2025, investigate the matter, and take appropriate action against the accused, namely, Saravana Praveen Kumar and his associates, in accordance with law.

2. The petitioner had sent a representation on 21.08.2025 against one Saravana Praveen Kumar, a woman Advocate and 20 others. Despite receiving the same, as the Police has not taken any steps, the writ petition has been filed by the petitioner.

3. The case of the petitioner is that her son, Raveendra Kumar, had availed a loan from Canara bank, Kotturpuram Branch and subsequently defaulted in its repayment. Thereafter, proceedings have been initiated under Secruitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 before the Debt Recovery Tribunal. It is stated that, pursuant to the order of the Debt Recovery Tribunal, the property was auctioned, and the successful bidder, after obtaining the sale certificate, attempted to take possession of the property on 30.03.2025. At that time, Saravana Praveen Kumar along with 20 others had assaulted the petitioner and her son. Subsequently, the said Saravana Praveen Kumar lodged a complaint on the very same day on 30.03.2025. On 31.03.2025, the petitioner has also lodged a complaint against Saravana Praveen Kumar and 20 others. As no steps have

been taken on the complaint lodged by the petitioner on 31.03.2025, the petitioner has lodged another complaint on 21.08.2025.

4. The learned Additional Public Prosecutor submits that the complaint lodged by Saravana Praveen Kumar was registered as Crime No.286 of 2025 and upon completion of investigation, a charge sheet was filed against the petitioner and her son.

5. Considering the submissions made on either side, it is seen that the petitioner had lodged complaints on 31.03.2025 & 21.08.2025 and no steps have been taken by the respondent Police. The respondent police is directed to cast an enquiry and to dispose of the petitioner's complaints in the manner known to law preferably within a period of three weeks from the date of receipt of a copy of this order.
