O R D E R

This Writ Petition is filed for a direction to the respondents 1 to 3 to take action against the present office bearers of the YA - 104 Ku.Vallam Cashew Nut Collecting Labours Contract Co-Operative Society at Ku.Vallam, Ariyalur District

based on the petitioner's representation dated 15.12.2021 within the time frame fixed by this Court.

2.By consent of the learned counsel appearing for the petitioner as well as Mr.T.K.Saravanan, learned Government Advocate who takes notice for the respondents, the Writ Petition is taken up for final disposal at the admission stage itself. 3.According to the petitioner, he is a member of YA - 104 Ku.Vallam Cashew Nut Collecting Labours Contract Co-Operative Society. The Society was formed only after agitations and protest made by people of K.Vallam and other surrounding villages and also based on the directions issued by the Hon'ble Apex Court for development of livelihood and employment of village people. Now, the said Society is not working properly. The office bearers of the Society are not taking effective steps for collection of cashew nuts. They are not properly accounting cashew nuts collected.

Further, without employing the members of the Society, they employed private persons to collect cashew nuts and sold it to merchants in the forest itself. The Secretary of the Society is affected with paralysis and is not discharging his duties. Hence, the petitioner made representations dated 26.05.2021 and 15.12.2021 to remove the office bearers of the Society and appoint new office bearers. Since no order is passed, the petitioner has come out with the present Writ Petition. 4.From the above materials, it is seen that the petitioner made serious allegations of mismanagement and misappropriation of the funds of the Society by office bearers of the said Society. In view of the same, the respondents 2 and 3 are directed to consider the representation of the petitioner dated 15.12.

2021 and pass orders on merits and in accordance with law, after giving opportunity of personal hearing to the petitioner, Secretary and other office bearers of the Society, within a period of eight weeks from the date of receipt of a copy of this order.

With the above directions, this Writ Petition is disposed of. No costs.
