This petition has been filed to register the petitioner's complaint dated 09.06.2016 in CSR No.421 of 2016.
2. Heard the Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.
3. No representation for the petitioner on 11.07.2016. Today also, there is no representation for the petitioner. On reading of the complaint dated 09.06.2016, it is alleged by the petitioner that his brother Shakel Ahamed is occupying the 1st floor of the family property and that, he is making alterations therein, even without a formal partition. In order to give criminal colour, the petitioner has stated that on 09.06.2016, some persons threatened the petitioner with knife. The dispute is essentially between brothers, with regard to the partition of property.
4. Hence, no positive direction can be issued to the respondent Police to register an FIR on the complaint dated https://hcservices.ecourts.gov.in/hcservices/
09.06.2016. However, the respondent Police is directed to conduct enquiry in CSR.No.421 of 2016 by calling both the brothers and advice them to maintain peace.
