Second Appeal filed under Section 100 of C.P.C. against the portion of judgment and decree dated 16.07.1998 of the learned Second Additional District Judge of Erode in partly allowing the First Appeal in A.S.No.164 of 1997 and modifying the judgment and decree dated 28.02.1997 of the learned District Munsif of Perundurai, in O.S.No.154 of 1995.

The learned counsel appearing for the appellants would submit that the sole appellant had died. Thereafter, the LRs has not taken any steps to implead themselves as parties in this appeal, despite the efforts taken by the appellant counsel. In view of the above the Second appeal is dismissed as abated. No Costs.
