ORDER

The petitioner/A7, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 465, 468, 471, 477(A), 420 r/w 34 of IPC in Crime No. 15 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. It is the second anticipatory bail petition filed by the petitioner. The earlier anticipatory bail petition in Crl.OP.No.28748 of 2024 was dismissed by Hon'ble Mr.Justice A.D.Jagadish Chandira on 06.01.2025 by making the following observations.

"5. Having heard the learned counsel for the petitioners, the learned counsel for the intervenor and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record and taking into consideration of the gravity of offence committed by the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners."

3. The case of the prosecution is that the accused, by fabrication of documents and falsification of account have diverted the company's money to the tune of Rs.3,38,61,227.86/-, misappropriated the same and cheated the company; and that the petitioner herein is arrayed as A7.

4. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has not derived any monetary benefit in the transactions and hence sought for bail.

5. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and on instructions 2/4

submitted that this is the second anticipatory bail petition and earlier petition was dismissed by this Court on 06.01.2025, considering the gravity of the offence.

6. The first anticipatory bail petition was dismissed considering the gravity of the offence committed by the petitioner. Further, this Court finds no change in the circumstances and hence, not inclined to entertain the second anticipatory bail petition.

7. Accordingly, the Criminal Original Petition stands dismissed. 24.03.2025 ars 3/4
