O R D E R
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2) and 318(4) of BNS Act, 2024 in Crime No.3 of 2025, on the file of the respondent police, seeks anticipatory bail.
2. It is the case of the prosecution that the petitioner had lured the defacto complainant and made him pay a sum of Rs.30,00,000/-; that the petitioner issued three cheques for a total sum of Rs.30,00,000/-; and that the first cheque for a sum of Rs.5,00,000/ was dishonoured on 03.03.2025.
3. When the matter was earlier taken up for hearing, the learned counsel for the petitioner submitted that the petitioner would settle the issues and honour the cheques issued by him.
4. The learned counsel for the defacto complainant submitted that the defacto complainant has now come to know that the petitioner has issued a Page No.2 of 5
letter to the Bank to stop the payment to the defacto complainant.
5. This court is of the considered view that the petitioner's action amounts to cheating and is in violation of the undertaking given before this court. Hence, this court is not inclined to grant anticipatory bail to the petitioner.
