HIGH COURT LEGAL SERVICES COMMITTEE, CHENNAI Lok Adalat-I organised by the High Court Legal Services Committee Friday, the 30th day of August, 2019 LOK ADALAT AWARD (Chapter VI and u/s 21 of Legal Services Authorities Act, 1987) Presided over by The Hon'ble Mr.JUSTICE M.Jeyapaul (Retd.) and Member Mr.N.Dhanasekaran Crl.RC.No.53 of 2018 This Criminal Revision Case has been filed under Section Sections 397 and 401 of the Cr.P.C, against the order dated 11.04.2017 passed in C.A.No.135 of 2016 on the file of the III Additional District and Sessions Judge, Coimbatore and the Order dated 02.09.2016 passed in C.C.No.343 of 2015 on the file of the Judicial Magistrate, Fast Track Court at Magisterial Level-II, Coimbatore.

C.Srinivasan ...Respondent/Respondent/Complainant On representation of both sides, this case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.A.Deivasigamani, the learned counsel for the Petitioner/Appellant/Accused and the Respondent/Respondent/Complainant(Party-in-Person) are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT

1. Pursuant to the efforts taken by the Lok Adalat, the complainant and the accused compromised their dispute relating to the present case under Section 138 of the Negotiable Instruments Act. It was informed to the Lok Adalat by both the parties that the accused paid in full quit of the claim made by the complainant, a sum of Rs.60,000/- (Rupees Sixty thousand only) and thereby compromised the entire dispute revolving the subject cheque issued by the accused in favour of the complainant.

2. In terms of Compromise arrived at between them it is jointly prayed by them that the offence alleged to have been committed by the accused under Section 138 of the Negotiable Instruments Act may be compounded in terms of Section 147 of the Negotiable Instruments Act.

3. In view there-of, the offence under Section 138 of the Negotiable Instruments Act framed against the accused, at the instance of the complainant is compounded as per Section 147 of the Negotiable Instruments Act. Resultantly, the conviction recorded by the Trial Court and confirmed by the Appellate Court is set aside and acquital in Crl.R.C.No.53 of 2018 is recorded. Accordingly, Criminal Revision petition is disposed of. Consequently, connected Miscellaneous Petition, if any, is closed.
