PRAYER: This Criminal Original Petition has been filed under Section 482 Cr.P.C. to transfer the investigation of the case in Crime No.299 of 2019 dated 16/10/2019 from the file of the Inspector of Police, Cyber Crime, Vepery, Chennai 600 007 to the file of Deputy Superintendent of Police, CBCID, Chennai for further investigation.

O R D E R

This Criminal Original Petition has been filed to transfer the investigation of the case in Crime No.299 of 2019 dated 16/10/2019 from the file of the Inspector of Police, Cyber Crime, Vepery, Chennai 600 007 to the file of Deputy Superintendent of Police, CBCID, Chennai for further investigation.

2. The learned counsel appearing for the petitioner submitted that petitioner/de-facto complainant lodged a complaint against his own employees stating that they have misappropriated the amount of the petitioner to the tune of Rs.2 crores by projecting false stock position and also adopting dubious methods. He further submitted that though FIR has been registered as early as on 16.10.2019, no fruitful investigation was done by the second respondent police till date and therefore the petitioner has filed this petition seeking transfer of investigation.

3. The learned Additional Public Prosecutor submits that in this case three persons who have installed the software have been enquired and their submissions have been recorded and the hard disc has also been seized and sent to forensic department for examination and report is awaited. He further submitted that further investigation would be based on the forensic report and in any event the investigation in this case will be completed within a period of six months.

4. Recording the submission made by the learned Additional Public Prosecutor, the second respondent is directed to complete the investigation and file final report, within a period of six months from the date of receipt of a copy of this order.
