ORDER
The petitioner/accused, who is facing trial in S.C.No.84 of 2025 on the file of the learned Principal District and Sessions Judge, Perambalur for offence under Sections 452, 294(b) and 307 IPC has filed this Criminal Original Petition seeking to quash the case filed against him on the ground of compromise. 2.Case of the prosecution is that the defacto complainant who is second respondent herein, has lodged a complaint before the first respondent police stating that the defacto complainant was living with her parents and was doing B.Sc course in a college in Veppanthattai. While so, the petitioner herein, who is the brother of defacto complainant's mother had insisted her to marry him and due to which, a complaint was already given.
Thereafter, the petitioner accused has gone to the house of the defacto complainant and picked up quarrel and threatened her that she should not give evidence against him in the court. Saying so, he had attacked her with knife and caused simple injury. Hence, a case in crime no.230 of 2023 came to be registered and after investigation, the final report was filed in and a case in S.C.No.84 of 2025 is taken on file before the learned Principal District and Sessions Judge, Perambalur. 3.The case is at the stage of trial. By passage of time, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.

4.Today the petitioner and the 2nd respondent appeared before this Court and their identity is confirmed by Mr.M.Arockiaraj, SSI attached to the 1st respondent Police Station. This Court also enquired both the parties and was satisfied that the parties have come to an amicable settlement between themselves. The petitioner and the 2nd respondent have filed separate affidavits before this Court and also filed the Joint Compromise Memo, dated 07.01.2026. 5.Under such circumstances, no useful purpose will be served in keeping the case pending, even though, the offences involved are not compoundable in nature. In the light of the guidelines given by the Hon'ble Supreme Court reported in (2017) 9 SCC 641-(Parbatbhai Aahir @ Parbatbhai Bhimsinhbhai Karmur Vs.
State of Gujarat), and after exercising due caution as advised by the Hon'ble Supreme Court in State of Madhya Pradesh v. Dhruv Gurjar and Another reported in (2019) 5 SCC 570, this Court in exercise of its jurisdiction under Section 482 Cr.P.C.,/Section 528 of BNSS is inclined to quash the proceedings in S.C.No.84 of 2025 on the file of the learned Principal District and Sessions Judge, Perambalur.
6.This Criminal Original Petition stands allowed and as a sequel, the proceedings in S.C.No.84 of 2025 on the file of the Principal District and 3/5
Sessions Court, Perambalur is quashed. No costs. Consequently, connected miscellaneous petitions are closed.
