Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition order passed in Crl.O.P. No.18171 of 2017 dated 06/09/2017.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.T.S.KANI Advocate for the petitioner and of MR.C.EMALIAS ADDL.PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- It is seen that after hearing the learned counsel for the petitioner in extenso, this Court had passed the order dated 06.09.2017, directing the petitioner to deposit a sum of Rs.50,000/- (Rupees fifty thousand only) and with a further condition to the learned Magistrate to disburse the same to the defacto complainant as ad-interim compensation.

This condition was imposed taking into consideration of the fact, as admitted by the petitioner, that there were financial dealings between the petitioner and the defacto complainant. However, it is the case of the defacto complainant that the petitioner had taken Rs.4,00,000/-, on the promise of getting her job and thereafter, had cheated the defacto complainant.

On an overall view of the facts and circumstances of the case, this Court had imposed the aforesaid condition. Hence the same cannot be modified. The petition is accordingly dismissed. If the petitioner fails to deposit the amount of Rs.50,000/-, the anticipatory bail, granted to the petitioner, shall stand automatically cancelled.
