The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5, 7 (3) of the Lotteries Regulation Act, 1998, in Crime No.81 of 2023, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused involved in selling of banned lottery tickets. Hence the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case based on the confession given by the co-accused. He would further submit that no lottery tickets were recovered from the petitioner herein/A2 and it was only recovered from A1. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) for the respondent Police would submit that the petitioner along with other accused involved in selling of banned lottery tickets. He would further submit that there are five previous case pending against the petitioner. Hence he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Taking into account the nature of offence and the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
